AMERICA’S CUP 2027 CUSTOMS PROCEDURES: ADM GUIDELINES NOW AVAILABLE ONLINE WITH CONTRIBUTIONS FROM ANDERSEN

The Italian Customs and Monopolies Agency (Agenzia delle Dogane e dei Monopoli – ADM) has published on its official website the Operational Guidelines on customs procedures and the transportation of goods in preparation for the 38th Louis Vuitton America’s Cup, the prestigious international sailing competition that will come to Naples in 2027.

The guidelines, officially presented in Naples on 22 September, have been prepared to provide teams, partners, logistics operators and other parties involved in the event with a clear framework of the procedures to be followed for the management of goods connected with the event.

Andersen also contributed to the development of these procedures, acting as America’s Cup’s exclusive legal and tax advisor, through the involvement and collaboration of its professionals with the customs authorities in analysing and developing the relevant customs aspects for managing the flow of goods in connection with an international event of this scale.

Customs simplifications and anti-fraud controls: what the Guidelines provide

The Guidelines are intended to simplify and streamline customs operations relating to the America’s Cup, covering the various stages involved in the entry, movement and subsequent exit of goods from Italian and EU customs territory.

The operational framework combines simplified procedures with anti-fraud controls through specific tools and measures:

  • Temporary admission: the possibility of bringing goods originating from non-EU countries into the territory while benefiting, where applicable, from an exemption from customs duties, followed by the re-export of the goods in accordance with the conditions laid down by customs legislation
  • Simplification of logistics flows: identification of dedicated procedures and codes to facilitate the identification and release of goods connected with the event
  • Anti-fraud controls and protection of intellectual property rights: particular attention to controls on goods and commercial products intended for the event, including clothing, merchandise and accessories
  • Controls on shipments: provision for specific analysis and control activities concerning goods entering through ports and airports, within the scope of the customs administration’s responsibilities

The approach adopted therefore aims to ensure speed and certainty in customs operations while maintaining appropriate levels of control and protection against the risks associated with international flows of goods.
