{"id":7511,"date":"2020-04-02T18:59:32","date_gmt":"2020-04-02T16:59:32","guid":{"rendered":"https:\/\/it.andersen.com\/declaration-of-outbreak\/"},"modified":"2020-06-26T12:59:00","modified_gmt":"2020-06-26T10:59:00","slug":"declaration-of-outbreak","status":"publish","type":"post","link":"https:\/\/it.andersen.com\/en\/declaration-of-outbreak\/","title":{"rendered":"Declaration of outbreak"},"content":{"rendered":"<p class=\"p1\"><span class=\"s1\">The spread of the coronavirus in Italy and the consequent <b>urgent measures adopted<\/b> by the Government have <b>imposed limits on the operations of companies and <\/b>in some cases even the <b>temporary closure<\/b> of the latter.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The<b> companies<\/b> working in the export system (and not only), due to the considerable restrictions in circulation imposed by almost all national governments, <b>risk paying expansive penalties<\/b> resulting from contractual breaches caused by the imposition of these restrictive measures. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">To deal with this situation, the <b>Ministry of Economic Development<\/b>, at the request of Confindustria, issued a <b>Newsletter on 25 March<\/b>. This Newsletter states that &#8220;at the request of the company, the locally competent <b>Chambers of Commerce<\/b>, within the powers granted to them by law, <b>may issue declarations in English<\/b> (a document supporting international trade) <b>concerning the state of emergency in Italy following the Covid-19 emergency and the restrictions imposed by law to contain the epidemic<\/b>&#8220;. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Therefore, companies may request a so-called &#8220;<b>declaration of outbreak<\/b>&#8221; from the territorially competent Chamber of Commerce, which <b>certifies that the applicant company was unable to fulfil its contractual obligations due to the imposition of these restrictive measure<\/b>s and not, therefore, due to facts dependent on its own will. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">It is important to clarify that the declaration issued by the Chamber of Commerce is not sufficient alone to exempt the company exhibiting this declaration from any responsibility for not fulfill the contract. It is therefore aimed at activating the force majeure clause.
