{"id":7192,"date":"2019-07-02T11:37:28","date_gmt":"2019-07-02T09:37:28","guid":{"rendered":"https:\/\/it.andersen.com\/invalidity-of-the-tax-assessment-received-by-registered-mail\/"},"modified":"2020-06-11T18:04:21","modified_gmt":"2020-06-11T16:04:21","slug":"invalidity-of-the-tax-assessment-received-by-registered-mail","status":"publish","type":"post","link":"https:\/\/it.andersen.com\/en\/invalidity-of-the-tax-assessment-received-by-registered-mail\/","title":{"rendered":"Invalidity of the tax assessment received by registered mail"},"content":{"rendered":"<p>With decision no. 757\/2019, the Piemonte\u2019s Regional Tax Court stated that the tax assessment served by registered mail, and not by the judicial officers, is legally non-existent.<br \/>\nAccording to the judges of Torino, the importance and the function of the act, not only lets the recipient know about the tax demand, but it also legitimizes the initiation of the enforcement procedures by the collection agents, demanding greater clarity in order to protect the taxpayer as per art. 60 of the Presidential Decree n. 600\/1973 .<br \/>\nIn the decision, it is excluded the possibility that the timely appeal produces healing effect under the art. 156 cpc since in absence of such notification, also the supposed \u201chealing\u201d provision is lacking.<br \/>\nThe CTR Piemonte\u2019s decision it is not exactly in line with the current Supreme Court\u2019s guidance and it could produce disruptive effects given that most of the assessment noticed would result as non-existent and therefore appealable.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>With decision no. 757\/2019, the Piemonte\u2019s Regional Tax Court stated that the tax assessment served by registered mail, and not by the judicial officers, is legally non-existent.
