Curated by the Firm\u2019s Energy <a href=\"https:\/\/it.andersen.com\/industry\/energy\/\">Industry Group<\/a> under the direction of partners <a href=\"https:\/\/it.andersen.com\/professional\/edoardo-fea\/\">Edoardo Fea<\/a> and <a href=\"https:\/\/it.andersen.com\/professional\/carlo-gioffre\/\">Carlo Gioffr\u00e8<\/a>, it provides an overview of the main legal and tax developments in the energy sector, in line with previous editions.<\/p>\n<p>In this edition, the <a href=\"https:\/\/it.andersen.com\/wp-content\/uploads\/2026\/04\/Andersen-Newsletter_Energy-in-Action_n.1-2026-ENG.pdf\">newsletter<\/a> focuses on recent developments in the energy sector, including key legislative changes such as the <strong>Bills Decree<\/strong> and <strong>DL Milleproroghe 2026<\/strong>. It also covers important tax updates, including <strong>incentives for capital investments<\/strong> and <strong>energy excise duties<\/strong>, as well as recent case law affecting EU energy regulations.<\/p>\n<h2>The news of the Bills Decree<\/h2>\n<p data-start=\"79\" data-end=\"338\">On 18 February 2026, the Council of Ministers approved Decree-Law No. 21, the \u201cBills Decree,\u201d introducing urgent measures to reduce electricity costs, enhance business competitiveness, support industrial decarbonisation, and address virtual grid saturation.<\/p>\n<p data-start=\"340\" data-end=\"560\">The decree introduces significant changes to the <strong>Conto Energia photovoltaic incentive schemes<\/strong>. Operators of plants over 20 kW with fixed premiums expiring from 1 January 2029 may voluntarily choose between two options:<\/p>\n<ol data-start=\"562\" data-end=\"1218\">\n<li data-section-id=\"p2lxse\" data-start=\"562\" data-end=\"846\"><strong data-start=\"565\" data-end=\"607\">Temporary reduction of premium tariffs<\/strong> to 85% or 70% for the second half of 2026 through 31 December 2027, in exchange for an extension of the incentive agreements by 3 or 6 months, with GSE applying average reduced tariffs. Participation must be communicated by 31 May 2026.<\/li>\n<li data-section-id=\"1urnppp\" data-start=\"848\" data-end=\"1218\"><strong data-start=\"851\" data-end=\"887\">Early withdrawal from incentives<\/strong>, permitted from 1 January 2028 for plants up to a total of 10 GW. Payments are distributed in ten annual instalments, adjusted at an interest rate capped at 6%. GSE manages any residual capacity through a competitive procedure by 30 June 2027. Operators who participated in the first scheme may also benefit from this procedure.<\/li>\n<\/ol>\n<p data-start=\"1220\" data-end=\"1506\">The decree also strengthens <strong data-start=\"1248\" data-end=\"1288\">long-term renewable energy contracts<\/strong>, with a focus on SMEs. It enhances the GSE platform with dedicated sections for contracts of at least three years, supports aggregation mechanisms, and allows GSE to act as a last-resort guarantor with SACE backing.<\/p>\n<p data-start=\"1508\" data-end=\"1671\">An additional incentive is introduced for renewable plants over 20 kW selected within the aggregation service framework, financed through general system charges.<\/p>\n<h2 data-start=\"1508\" data-end=\"1671\">DL Milleproroghe 2026<\/h2>\n<p data-start=\"67\" data-end=\"291\">Bill A.S. No. 1812, converting into law Decree-Law No. 200 of 31 December 2025 (the so-called \u201cMilleproroghe\u201d), was approved by the Chamber of Deputies on 23 February 2026 and transmitted to the Senate on 24 February 2026.<\/p>\n<p data-start=\"293\" data-end=\"482\">The bill <strong>postpones<\/strong> the <strong>obligation to integrate thermal energy from renewable sources<\/strong>, setting <strong>1 January 2026<\/strong> as the <strong>new effective date<\/strong>, in accordance with Article 13(2) of the Decree-Law.<\/p>\n<p data-start=\"484\" data-end=\"805\">It amends <strong>Article 27(1)<\/strong> of <strong>Legislative Decree No. 199\/2021<\/strong>, delaying the obligation for companies selling thermal energy for heating and cooling to third parties exceeding 500 tonnes of oil equivalent (TOE) per year. These operators are required to ensure a portion of the energy sold originates from renewable sources.<\/p>\n<p data-start=\"807\" data-end=\"1107\">The detailed implementation framework &#8211; including annual increase trajectories, compliance verification, and regulation of compensatory contributions through the <strong>Energy and Environmental Services Fund (CSEA)<\/strong> &#8211; will be established by a decree of the Minister for the Environment and Energy Security.<\/p>\n<p data-start=\"1109\" data-end=\"1350\">The government justified the postponement to allow alignment with the European Commission\u2019s guidelines on waste heat and cold, published on 2 September 2024, and with the updated European framework under <strong>Directive (EU) 2023\/2413 (RED III)<\/strong>.<\/p>\n<p data-start=\"1352\" data-end=\"1783\">The provision also aligns national measures with broader European and national <strong>renewable energy targets<\/strong> in the thermal sector. Targets under Article 3 of Legislative Decree No. 199\/2021 must now be interpreted in light of <strong>RED III<\/strong> and <strong>PNIEC 2024<\/strong>, which set higher renewable energy targets for heating and cooling by 2030, explicitly recognising waste heat recovery and the renewable share of electricity used for thermal purposes.<\/p>\n<h2 data-start=\"1352\" data-end=\"1783\">2026 Budget Law: increase in depreciation for investments in capital goods<\/h2>\n<p data-start=\"70\" data-end=\"297\">The <strong data-start=\"74\" data-end=\"93\">2026 Budget Law<\/strong> (Article 1, paragraphs 427\u2013436) introduces a <strong data-start=\"139\" data-end=\"156\">tax incentive<\/strong> to support the <strong data-start=\"172\" data-end=\"194\">digital transition<\/strong> of businesses and encourage investments in <strong data-start=\"238\" data-end=\"259\">new capital goods<\/strong> for production facilities in Italy.<\/p>\n<p data-start=\"299\" data-end=\"601\">The incentive allows an <strong data-start=\"323\" data-end=\"359\">increase in the acquisition cost<\/strong> of assets for calculating <strong data-start=\"386\" data-end=\"417\">tax-deductible depreciation<\/strong> (IRES and IRPEF) and lease payments, up to <strong data-start=\"461\" data-end=\"469\">180%<\/strong>, depending on the amount of eligible investments. Eligible investments must be made from <strong data-start=\"559\" data-end=\"598\">1 January 2026 to 30 September 2028<\/strong>.<\/p>\n<p data-start=\"603\" data-end=\"1033\">Access to the incentive requires submission of <strong data-start=\"650\" data-end=\"687\">communications and certifications<\/strong> through the <strong data-start=\"700\" data-end=\"714\">GSE portal<\/strong>, with implementing provisions to be defined by a <strong data-start=\"764\" data-end=\"786\">Ministerial Decree<\/strong> by 31 January 2026. Beneficiaries are taxpayers operating legitimate business activities who comply with workplace safety and social security obligations. Excluded are companies in liquidation, bankruptcy, or subject to disqualifying sanctions.<\/p>\n<p data-start=\"1035\" data-end=\"1410\">Both <strong data-start=\"1040\" data-end=\"1056\">owned assets<\/strong> and assets acquired via <strong data-start=\"1081\" data-end=\"1102\">financial leasing<\/strong> qualify, including <strong data-start=\"1122\" data-end=\"1163\">tangible and intangible capital goods<\/strong>, renewable energy self-generation systems, energy storage systems, and photovoltaic systems manufactured in the EU with minimum efficiency requirements. Eligible assets must be <strong data-start=\"1341\" data-end=\"1359\">interconnected<\/strong> with the company\u2019s production or supply network.<\/p>\n<p data-start=\"1412\" data-end=\"1758\">The intensity of the incentive varies by investment size: <strong data-start=\"1470\" data-end=\"1478\">180%<\/strong> up to \u20ac2.5 million, <strong data-start=\"1499\" data-end=\"1507\">100%<\/strong> for \u20ac2.5\u201310 million, and <strong data-start=\"1533\" data-end=\"1540\">50%<\/strong> for \u20ac10\u201320 million. The incentive can be combined with other national or EU grants, provided there is no <strong data-start=\"1646\" data-end=\"1666\">double financing<\/strong>, but cannot be combined with the <strong data-start=\"1700\" data-end=\"1718\">4.0 tax credit<\/strong> claimed for investments in 2025\u20132026.<\/p>\n<p data-start=\"1760\" data-end=\"1913\">The incentive is forfeited if the asset is sold or transferred abroad, unless replaced with a <strong data-start=\"1854\" data-end=\"1883\">similar or superior asset<\/strong> within the same tax period.<\/p>\n<p data-start=\"1915\" data-end=\"2074\">Finally, the law establishes a <strong data-start=\"1946\" data-end=\"1967\">\u20ac1.3 billion Fund<\/strong> within the MEF budget to increase resources for the <strong data-start=\"2020\" data-end=\"2049\">4.0 investment tax credit<\/strong>, previously exhausted.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Energy in Action newsletter is back.
