{"id":29561,"date":"2025-10-01T15:39:04","date_gmt":"2025-10-01T13:39:04","guid":{"rendered":"https:\/\/it.andersen.com\/?p=29561"},"modified":"2025-10-03T15:40:49","modified_gmt":"2025-10-03T13:40:49","slug":"italian-law-on-artificial-intelligence-published-in-the-official-gazette","status":"publish","type":"post","link":"https:\/\/it.andersen.com\/en\/italian-law-on-artificial-intelligence-published-in-the-official-gazette\/","title":{"rendered":"Italian Law on Artificial intelligence published in the Official Gazette"},"content":{"rendered":"<p>Law No. 132 of 23 September 2025, containing provisions and delegated powers to the Government on the subject of <strong>artificial intelligence<\/strong>, was published in Official Gazette No. 223 of 25 September 2025 and will come into force on 10 October 2025.<\/p>\n<p>The text does not introduce new obligations with respect to the European <strong>AI Act<\/strong>, but rather complementary provisions based on the requirements imposed on Member States by the AI Act itself and to take into account the specificities of the national context.<\/p>\n<h2>The objective of the Italian Law on Artificial Intelligence<\/h2>\n<p>The Italian Artificial Intelligence Law, consisting of 28 articles, will support the European AI Act (Regulation (EU) 2024\/1689) in promoting the responsible use of artificial intelligence, while defining a <strong>system of principles, governance and specific measures<\/strong> to <strong>mitigate the risks <\/strong>of artificial intelligence.<\/p>\n<h2>The anthropocentric dimension and the main new features<\/h2>\n<p>The approach, defined as <strong>anthropocentric<\/strong>, aims to promote the proper, transparent and responsible use of AI, while ensuring vigilance with regard to economic and social risks and the impact on fundamental rights.<\/p>\n<p>The provisions introduced concern, on the one hand, the use of AI in particularly sensitive sectors (health, work, intellectual professions, scientific research, justice and public administration) and, on the other hand, industrial policy and innovation measures, including significant new developments in the area of liability and <strong>copyright<\/strong>.<\/p>\n<p>In criminal law, the Law also introduces a common aggravating circumstance for offences committed with the aid of AI and the new offence of unlawful dissemination of generated or altered content (in particular <strong>deepfake<\/strong>).<\/p>\n<h2>What companies that use AI must do<\/h2>\n<p>While awaiting the implementing decrees, which will be issued within 12 months, companies that adopt artificial intelligence systems must begin to implement measures aimed at ensuring regulatory <strong>compliance<\/strong>, thereby building an effective <strong>governance system<\/strong>.
